NearGo END USER LICENSE AGREEMENT (EULA)

Version: 1.2 Effective date: 3 June 2026

1. LICENSE

Podjetniški Projektni Center ANAplus d.o.o. grants you a non-exclusive, non-transferable, limited license to:

• Download the NearGo application from the Apple App Store or Google Play
• Install it on devices you personally use
• Use the application in accordance with the Terms of Use

2. RESTRICTIONS

You may NOT:

• Reproduce or distribute the application
• Modify or create derivative works
• Reverse engineer, decompile, or disassemble
• Remove copyright notices
• Use it for unlawful purposes

3. APPLE-SPECIFIC PROVISIONS (iOS only)

For users of the iOS version of the application, additional provisions apply:

3.1 The agreement is between the user and NearGo

This license is concluded between the user and Podjetniški Projektni Center ANAplus d.o.o., NOT Apple. Apple is not responsible for:

• The application
• The content
• Maintenance
• Technical support

3.2 Apple's rights

Apple and its subsidiaries are third-party beneficiaries of this EULA. Apple has the right (but is not obligated) to enforce this EULA against you.

3.3 Warranty

NearGo provides a warranty as described in the Terms. Apple does not provide a warranty.

3.4 Product complaints

Complaints regarding the application (e.g. it does not work, breach of quality) will be handled by NearGo, not Apple.

3.5 Intellectual property

In the event of infringement of third-party rights, the responsibility lies with NearGo, not Apple.

3.6 Compliance with sanctions

The user declares that:

• They are not in a country subject to U.S. or EU sanctions
• They are not on a list of prohibited persons (U.S. Treasury Department)

4. GOOGLE PLAY-SPECIFIC PROVISIONS (Android only)

For users of the Android version of the application, the Google Play Terms of Service and Developer Distribution Agreement apply.

5. TERMINATION

The license is valid until termination. It may be terminated:

• By deleting the application
• By breach of this EULA
• At NearGo's decision

After termination, you must delete the application from all devices.
