NearGo TERMS OF USE

1. INTRODUCTORY PROVISIONS

2. SERVICE DESCRIPTION

2.1 What is NearGo

NearGo is an international mobile application that enables:

NearGo distinguishes between the following types of offers:

  1. Coupons — free discounts on services (e.g. hair salon, restaurant); the user claims the coupon free of charge and redeems the discount directly at the provider.
  2. Free Promo — free exclusive offers or promotional free tickets (e.g. for Premium users), claimed via a QR code.
  3. Service reservations — booking a time slot with a service provider via the NearGo calendar.
  4. Free events — information about events, including external sources (e.g. Ticketmaster) with a link-out to an external page.

In NearGo, the term "ticket" refers exclusively to a free confirmation (a coupon or promotional ticket) with QR pickup — NearGo does not carry out paid ticket sales.

2.3 NearGo's role as intermediary

NearGo is a digital platform and intermediary between providers and users.

4. PAYMENTS AND PRICES

4.1 Payment systems

NearGo uses the following payment systems:

a) Stripe — for payments of services (reservations), vendor subscriptions (Grow/Pro) and featured placements (featured boost). All these payments are charged by Podjetniški Projektni Center ANAplus d.o.o. via its own Stripe account. NearGo does not store card data; it is processed exclusively by Stripe. These transactions are real-world services or B2B exceptions under Apple/Google guidelines.

b) Apple In-App Purchase (iOS) and Google Play Billing (Android) — EXCLUSIVELY for the NearGo Premium consumer subscription (digital content for the consumer).

c) Invoice language — Invoices are issued in the language in which the user uses the app. The app supports Slovenian, English, German, Italian, Croatian, French, Spanish, Polish, Czech and Slovak. The original invoice is also stored in the app under “My” → “My invoices”.

All prices include VAT at the applicable rate based on the user's location and legal regulations.

4.4 Payments to providers

For coupons (service discounts, free gifts) the provider does NOT receive payment through NearGo. The customer claims the coupon free of charge through the app; service performance and the final settlement happen directly between the customer and the provider.

All active payments (service reservations, vendor subscriptions, featured placements) are charged by Podjetniški Projektni Center ANAplus d.o.o. via its own Stripe account. Paid ticket sales and the associated provider payouts are not active in the app.

4A. SERVICE RESERVATIONS, NO-SHOWS AND CANCELLATION POLICY

4A.1 Reservations through NearGo

Service reservations are made exclusively through the NearGo app. The system supports:

4A.2 Cancellation policy

When creating an offer, each provider chooses one of the following cancellation policies:

The cancellation policy is shown to the customer on the offer card before confirming the reservation.

4A.3 No-show counter

If the customer does not show up for a reserved slot and does not cancel in line with the cancellation policy, the provider may mark the reservation as a "no-show" at the earliest 30 minutes after the slot start.

NearGo reserves the right to permanently restrict or block the account in case of systematic abuse (more than one 30-day ban within 12 months).

In any case, NearGo's liability is limited to the amount the user paid to NearGo in the last 12 months, or €100, whichever is less.

NearGo is not liable for failure to fulfill obligations due to force majeure (natural disasters, wars, pandemics, government decisions, internet network disruptions).
